Admission of Responsibility in Toddler's Death

A nursery and one of its employees have admitted responsibility for the death of a 14-month-old boy.

Noah Sibanda died following an incident at the now-closed Fairytales Day Nursery, located on Bourne Street, Dudley, on 9 December 2022.

Court Proceedings and Charges

Nursery worker Kimberley Cookson, aged 23, pleaded guilty to gross negligence manslaughter on Wednesday at Wolverhampton Crown Court. The charge relates to her actions in placing Noah to sleep face-down on a soft cushion and restraining him with her leg.

Fairytales Day Nursery Limited also admitted to one count of corporate manslaughter and an offence under the Health and Safety at Work Act during the same hearing.
