Lady Donaldson Declared Unfit to Stand Trial
Lady Eleanor Donaldson, spouse of former Democratic Unionist Party (DUP) leader Sir Jeffrey Donaldson, has been found unfit to stand trial due to mental health reasons.
Consequently, Lady Donaldson will undergo a trial of facts, a legal procedure applied when a defendant is unable to participate in a conventional trial because of serious health issues.
This decision was made by Judge Paul Ramsey at Newry Crown Court on Wednesday, following the presentation of medical evidence.

Lady Donaldson, aged 59, and her husband, Sir Jeffrey Donaldson, 63, both deny a total of 23 sexual abuse charges.
In contrast to a standard trial, a trial of facts does not allow a jury to deliver a guilty verdict; instead, the jury assesses whether the alleged acts were committed. The defendant cannot be convicted but may be acquitted.
This procedure is governed by Article 49A of the Mental Health (Northern Ireland) Order 1986.
During the trial of facts, the defendant is represented by legal counsel but does not actively participate in the proceedings.

Sir Jeffrey Donaldson has pleaded not guilty to 18 alleged offences, which include one count of rape, as well as allegations of indecent assault and gross indecency. These offences are said to have occurred between 1985 and 2008 and involve two alleged victims.

Medical Evidence Presented
The court received evidence via video-link from Dr Christine Kennedy, a consultant psychiatrist who has examined Lady Donaldson and authored two reports, the latest completed just days prior to the hearing.
Dr Kennedy stated that Lady Donaldson is currently incapable of instructing her lawyers, following court proceedings, or giving evidence.
Next Steps in the Legal Process
Prosecutors have proposed that Sir Jeffrey Donaldson proceed with a standard trial scheduled to begin next Tuesday, while Lady Donaldson undergoes the trial of facts simultaneously.
Judge Ramsey heard legal arguments concerning whether the trial of facts should be conducted concurrently with Sir Jeffrey Donaldson’s trial or separately at a later date.
The judge is expected to deliver a ruling on this matter on Thursday.
