Legal Battle Over Euthanasia Rights

A Spanish woman who engaged in an extended legal dispute with her father over her right to end her life is scheduled to undergo euthanasia on Thursday.

Noelia Castillo, a 25-year-old resident of Barcelona, became paraplegic following injuries sustained during a suicide attempt in 2022.

The Catalan government approved her request for assisted dying in the summer of 2024. However, the procedure was halted at the last moment due to legal challenges initiated by her father, supported by the conservative advocacy group Christian Lawyers (Abogados Cristianos).

Her father contended that Noelia suffered from a personality disorder impairing her judgment. He emphasized

"the obligation of the state to protect the lives of people, especially the most vulnerable, as is the case with a young person with mental health problems"

This appeal triggered an 18-month legal process, culminating in a ruling by the European Court of Human Rights (ECHR) in favor of Noelia Castillo.

Noelia Castillo’s Personal Account

In an interview with Spanish television earlier this week, Castillo stated that her father attempted to legally obstruct her choice to die with dignity.

"He hasn't respected my decision and never will,"
she said.

She also shared details of her challenging upbringing, much of which was spent in care homes.

Castillo revealed that she was first sexually assaulted by her ex-boyfriend of four years after taking sleeping pills to aid sleep. She also recounted another assault by multiple men at a nightclub.

The 25-year-old expressed that she had always

"felt alone"
and was resolute in her decision to proceed with euthanasia.

"Nobody in my family is in favour,"
she stated.
"I am leaving and you are staying here with all the pain, but what about all the suffering I have endured over the years? I just want to leave in peace and stop the pain."

She added,

"The happiness of a father or a mother or a sister shouldn't precede the happiness of a daughter."

Regarding the procedure, Noelia said her family would be allowed to say their goodbyes, but she wished to be alone with her doctor when the lethal injection is administered.

Spain’s euthanasia law, which came into effect in 2021, permits assisted dying under specific conditions. Government data indicates that 426 requests for assisted dying were approved in 2024, the latest year for which statistics are available.

This case marks the first instance where a court was required to adjudicate on euthanasia rights.
