Incident at Edinburgh Shell Garage
A man who attempted to kill a police officer using a stolen vehicle has been sentenced to 11 years in prison.
Thomas Malone entered a Mercedes Benz parked outside a burger shop on Gorgie Road, Edinburgh, on 9 July 2024, unaware that the owner's 16-year-old son was in the back seat watching videos on his phone.
Malone, aged 29, drove away but shortly afterward allowed the distressed teenager to exit the vehicle. He was then observed driving erratically, including "fish-tailing" out of control, veering into the path of a bus, and colliding with another car, which left the Mercedes severely damaged.
Attempt to Stop Malone at Petrol Station
Police Constable Adam Brealey intervened at a Shell petrol station on Stenhouse Road, attempting to stop Malone by leaning into the car. However, Malone drove off, and the officer was subsequently struck by a vehicle at a fuel pump.
Malone had previously admitted to charges including attempted murder, dangerous driving, and abduction.
The High Court in Glasgow heard details of the incident, including PC Brealey's efforts to prevent Malone's escape.
"PC Brealey grasped Malone's hands. He struggled and failed to comply with instructions to stop the engine," said Nicola Gilchrist, prosecutor. "The officer activated his emergency radio signal as Malone began reversing. PC Brealey has limited recollection thereafter and next recalls being on the ground."
Details of the Collision and Pursuit
Malone, from Edinburgh, drove the Mercedes forward, colliding with another vehicle near a petrol pump while PC Brealey remained leaning into the driver's window.
"Malone then drove between two cars at adjacent fuel pumps striking a second vehicle," Gilchrist stated.
During this, the officer also collided with one of the vehicles and fell to the ground.
"Malone continued towards the exit, collided with a pole, attempted to unsuccessfully reverse and then exited the vehicle fleeing on foot. He was pursued by a member of the public and other officers before being apprehended nearby," the prosecutor added.
Aftermath and Injuries
PC Brealey was hospitalized and required 12 months off work. Upon returning, he was placed on restricted duties. As of December 2025, the officer continued to experience reduced movement in his right shoulder.
Malone's Criminal History and Sentencing
During the hearing, it was revealed that Malone had over 30 previous convictions, including offences against police officers.
Defence lawyer Marco Guarino commented on Malone's remorse.
"It is quite clear, in the cold light of day, that he has found it very difficult to come to terms with the fact that he caused a police officer to be badly hurt. For the grace of God, it was not worse."
In addition to the prison sentence, Lord Renucci ordered Malone to be supervised for three years following his release and imposed a driving ban lasting 13 years and six months.
The judge described Malone's actions as "shocking and reprehensible."
"Members of the public and police officers, who risk their lives, deserve to be protected by the behaviour exhibited by you," Lord Renucci stated.
