High Court Orders Arrest of Enoch Burke's Mother and Sister
The High Court in Dublin has issued an order for the arrest and imprisonment of Martina and Ammi Burke, mother and sister of teacher Enoch Burke, on grounds of contempt of court.
Enoch Burke, a teacher from County Mayo, has been involved in an extended legal dispute after defying court orders to remain away from his former workplace. This conflict arose following his refusal to use the preferred pronouns of a transgender student.
Mr Justice Brian Cregan ruled that Martina and Ammi Burke should each be jailed for two weeks due to their conduct during a court hearing held last month.
The judge noted that both women repeatedly interrupted the proceedings and were subsequently removed from the courtroom by gardaí (Irish police).
According to Irish broadcaster RTÉ, Mr Justice Cregan emphasized that the rule of law applies to the Burke family regardless of their acceptance of it.
He further remarked on the unusual circumstance of requiring the presence of 10 gardaí during the Burke-related court cases, stating that such a situation was abnormal and unsustainable.
Contempt of Court
Mr Justice Cregan detailed that Ammi Burke interrupted court proceedings to the extent that an application by Wilson's Hospital School could not be properly heard or addressed.
The judge added that Ammi Burke showed no remorse for her behaviour.
He observed that both Martina and Ammi Burke appeared to consider themselves above the law due to their Christian evangelical beliefs.
"We live in a democracy governed by the rule of law - not a theocracy, governed by the Burke family."
Mr Justice Cregan also noted that Ammi Burke is a solicitor and announced his intention to forward relevant documents to the disciplinary committee of the Law Society for consideration of a possible inquiry.
Attendance at Future Hearings
The judge indicated plans to issue an order requiring Martina Burke, Ammi Burke, and another family member, Isaac Burke, to attend future court hearings remotely.
He granted them a period of three weeks to submit any objections to this proposed order.
During the hearing, Martina and Ammi Burke were called twice by the registrar, but Isaac Burke informed the judge that they were at their place of employment.
Mr Justice Cregan noted that the parties had been informed the previous week that the proceedings would take place on Wednesday.
